MBBS student moves HC, gains revaluation of 6 anatomy questions

He failed by ‘just’ two marks in the paper and sought five grace marks as he had failed in only that one subject
A management quota MBBS student approached the High Court of Karnataka seeking five grace marks so that he could pass in one subject. He had failed the subject by only two marks. His claim was that his answers in the subject were “squarely based on a book” that was used as syllabus in the college. The HC arrived at a decision that would not affect either the health university RGUHS or the student. His answer paper for the subject was ordered to be revaluated, but there would be no grace marks.

Sandhula Narsimha Sagar, the 21-year-old MBBS student of MR Medical College, approached the HC with the petition seeking a direction to the RGUHS to award seven marks to him including five grace marks and declare that he had passed in the Anatomy paper of the exam he took in July 2015.

He claimed that he had given correct answers in the paper but he had been given two marks less than the pass marks. He had joined the MBBS course in 2012-13 under the management quota. In the “first phase” of the course, he had appeared in two subjects but could not attend the Anatomy exam as he did not have requisite attendance. He failed in the other two subjects as well.

In December 2014, he managed to pass one of the other subjects but failed in the other two including Anatomy. Again in June 2015, he made one more attempt at the two subjects and passed one but failed in Anatomy again. This time, he “was surprised to see that he could not clear his Anatomy paper despite his laborious preparation.”


Sagar claimed that since he failed in a single paper, he was entitled to five grace marks. He claimed that if his paper was revaluated, he would have definitely got the two marks to pass the subject.

The student further told the court that he had attempted 22 questions in the paper and for six of those questions he had not been allotted marks though he wrote everything according to a particular book. His advocate argued that according to the regulations of RGUHS, a student was entitled to five grace marks if he had failed in just one subject.


The HC said, “While the revaluation would not adversely affect the interest of the respondent, it may protect and promote the interest of the petitioner.” The RGUHS was directed to revaluate the six questions that he was claiming marks for and announce the result within one month.
