Suzy loses damage suit against online shop

JYP Entertainment, the label of Miss A member Suzy, said Sunday that it had not yet decided whether to lodge an appeal against an online shopping mall that it claimed illegally used Suzy’s name to advertise the company.

JYP, one of the nation’s largest entertainment agencies, filed a damage suit with Seoul Central District Court against the Web store, claiming that it made use of Suzy’s fame without permission.
But JYP lost the lawsuit, with the court citing insufficient evidence.

In the ruling, the court said, “There is not enough evidence that Suzy and her label could not sign a contract with other parties or suffered financial losses due to the online mall’s alleged violation of Suzy’s publicity rights.”

The online shop signed a contract in September 2011 with a local portal site to make its Web address appear when netizens typed the keyword “Suzy’s hat” in the search engine for more than two years.
The company also posted three photos of Suzy, titled “Suzy’s interview” and “Suzy’s fashion at airport,” to lure netizens to the website, the label said.

The court has dismissed cases regarding the publicity rights of celebrities.

So far, 55 celebrities including K-pop groups Super Junior, Girls’ Generation and Wonder Girls have filed for compensation against portal sites, but all have been rejected.
